New fish - Health issues or settling in?

Hi everyone; well, after loving the betta I got back in April I bought another two days ago. He's my first CT - very pretty but acting strange. I'm not sure if he's just settling in or if there is something wrong with him. Just a few points:

-Wont eat (Ive tried pellets and flakes)
-Doesn't come to the surface often; I lowered the water level a few minutes ago though
-He hardly moves
-Not sure if this means anything but his mouth looks like it's not closed all the way? It sort of looks like hes panting very slowly
-I can see his gills pumping hard although he isn't moving much (again, I don't know if this means anything ^^;)
-When I first put him into the tank he was circling it and flaring up a lot

So.. does this sound more like stress or sickness to you all? Sorry if it sounds silly but my first fish never acted like this (of course they're all different :})

New Betta would need time to accommodate food,please be patient. And your fish looks fine,BTW. One of my Betta has no eating within 3 days when I brought him home.

How big is the tank and is this a new set-up for the new Betta or is it an old set-up and what is the water temp?
