it is happy,healthy, and territory (sort of) it isn't for breeding all the time, unless there next to a female of course

It's not always happiness. A change in conditions will prompt it too (such as a water change, a move etc), even in really sick bettas. However, I'm sure that isn't the case here. :) Apart from the fin, he looks healthy. :)
