Exclamation still not moving!

now yoshiko isent layed at the bottom of my tank but instead he is huddled by the filter at the top of the tank i dont know what to do is he still settling into his new home because i only got him this morning?

Yeah, he's still settling in. A few of my bettas were like that for the first few hours, then got better. Try piquing his interest with some food, that might help- mine always became more active when gave them food. If he doesn't eat it, or it starts to sink, remove it, they mold if they're in the water too long.

If you just got him today, it may be an adjustment period for him, have you checked the water temp? if that is okay within 78-80F and he is still lethargic you can make a small 25-30% water only change by dipping the water out so not to disturb him too much to rule out environment issues if it is not temp related.
I am sure you know to do this already, but remember to use dechlorinator with any new water added if you are on city water supply and keep the water within a couple of degrees between new and old water so not to temp shock him.

But he may just need more time to settle in, turning off the light can also help

im getting some pics tommorow because its soo hard to take a pic of him when he is huddled in a corner.
(and im rubbish at taking pics!! any advice !)
And i just thought i would add he is flaring when i put a mirror in front of him does that mean he is healthy?

Wow...so sorry for your loss....I hope you will take him back and get your money back and get another Betta...

Sometimes we get sick fish from the start and nothing you could have done to change that or anything you did wrong that caused his death...these things happen....so don't give up....
again sorry for your loss.....
