I have two of them and both the filters are quiet.

In the paperwork that came with your tank, there is a red piece of paper that gives you the company number if there is a problem. Call them and tell them you have a defective filter.

Oh, here, I have the paperwork from mine. The number to call is 1-800-545-1344.

Hope that helps and good luck!

but it's so annoying, can I unplug it for the night, I'll need to sleep eventually?

They can send you a new filter if this one is defective. There is NO WAY, IMO, it should be making that much noise - mine sure don't!!!

I don't think you are supposed to unplug the filter, but if that's what you have to do, that's what you have to do. :(

I don't know what tank your talking about but I had a filter that would do a loud Grrrrrr sound when it wasn't primed right after cleaning it. I had to add water to the filter compartment with a large cup or pichure at the same time I pluged it in to start it up running. It made that sound because it was trying to suck up water from the tank but couldn't get suction without water being already in the filter compartment first. Not sure this will help but I just thought I'd try :)

It's the Hawkeye 5 gallon aquabrite kit from Wall-Mart, it has an aqua tech filter.
You do have to fill it up before starting it, but mine still grr's even with the water in it.
