Is he dying??

My fish has been acting a little unusual lately. He doesn't try very hard to swim and I often find him sitting on the rock in his tank almost like a human sitting in a chair. You can see this in the pictures below. What's wrong with him?? :(

Poor guy.. =(

First you should lower the water to 3-4 inches at most so he can get air easier.

Without some further information it is hard to say what had happened, and what is happening to him..
What size tank is his home?
What is the temp?
What is your water changing routine? How much & how often? When did you do it last?
Do you use conditioner? Did you add anything in his water other then the conditioner?
What water source are you using?
Did you test his water for ammonia/nitrate/ites? If so what were the parameters?
What do you feed him and how much/often?
Any other symptoms, or has his appearance changed any?

What is the temp? 75-80
What is your water changing routine? How much & how often? When did you do it last? I made the mistake of going a few weeks without changing, only adding. But today I did a major cleaning, at least 80%.
Do you use conditioner? Did you add anything in his water other then the conditioner? Yes; no.
What water source are you using? Tap (with conditioner)
Did you test his water for ammonia/nitrate/ites? If so what were the parameters? No.
What do you feed him and how much/often? Beta pellets every day, or freeze-dried bloodworms occasionally.
Any other symptoms, or has his appearance changed any? No.

Poor guy.. he looks thin too =( How many pellets are you feeding a day?
It was probably a build up with the lack of cleaning..
For now I would make sure his water level is low, do daily 100% water changes and if you see he is having trouble swimming, staying upright then you can start an Epsom Salt treatment - 1 tsp per gallon, 100% daily water changes for 10 days. Float/tape the Qt container in the tank to keep the temp warm.

So if the water level is too low, the filter won't really work. Is that a problem? Can I just lower the water and unplug the filter?

Yeah, unplug the filter and keep the water level 3-4 inches.
Is he gasping or swimming frantically?

No better :( He's losing a LOT of color, and doesn't even swim up to get food anymore. He spends alot of time resting in the plant. I'm scared this is his last weekend :(
