Do you think you can post a picture?
I'm thinking it's either Swim Bladder issues or bloating. But it can be fixed rather easily.
It also might have to do with the fact that he's new and not yet used to his new home. Try to keep quiet around his tank so he doesn't flip out again. :)

EDIT: It's good that you have him in lowered water!

the cup was floating in the tank but i took it out for the picture. He got up off his side when i did, but now is back to laying on his side

He also seems to be trying to swim up for air, but his fins move and he doesn't go anywhere

That is so strange... I say leave him for tonight- since we don't know if he has anything serious and treating without knowing what to treat for can be dangerous. :(
I'm sorry he's not feeling well.

Sounds a little bit like what's going on with my betta! Make sure to keep the water really clean, I think. I'm sure someone will be around with more information. Mine just lays around on his side as well, or sometimes 'stands' on his back fin
